Indian CIC Extends RTI to Cover Private Schools

20 June 2014

India’s Central Information Commission has ruled that the Right to Information Act applies to private schools.

The CIC decided that RTI coverage is justified when private schools are governed by laws such as the Delhi Education Act that regulate the schools, including their salaries. The requester was a former school employee.

The short decision, Ms. Sadhana Dixit Vs. Directorate Of Education, can be found here.

Information Commissioner Sridhar Acharyul wrote,  “Under Right to Education Act 2009 also, the recognized school is under an obligation to appoint eligible teachers and provide them with prescribed wages. This also reveals that it has given inherent Right to Information to the teachers from their employers.”
